As some of you continue to battle mesothelioma, others have passed away from meothelioma and asbestos. Since mesothelioma takes many years to develop, it is likely you will be in later stages of cancer before you receive a diagnosis. Due to this, many people die before they ever get a settlement. If prior arrangements are not made, this can be a very trying time.

If someone has passed away from mesothelioma, the family is still entitled to money. However, depending on your title, you may or may not receive compensation. First, if you or someone you know has mesothelioma, they need to make arrangements concerning their award. This can be done by a living will. However, depending on which state you live in, it may or may not hold up in court.

The court will follow a specific family chart to see who is entitled to the victim's mesothelioma award. If the deceased is married, with children or not, they will be awarded the claim. Now, if the deceased is not married, it will go to the biological children evenly. If the children have passed away, i will usually go to the grandchildren then. If there is no children or grandchildren, it may go to a parent or sibling.

The best thing to do is to make a living will or a video will. If possible, you can do both. This will help in court, even if it doesn't hold up in court. Your final wishes are very important and you want to make sure they are followed through.
